PROCEEDINGS OF THE COUNCIL OF THE CITY OF ALEXANDRIA, LOUISIANA, STATE OF LOUISIANA, TAKEN AT A SPECIAL MEETING HELD JUNE 2, 2009.

The Council of the City of Alexandria, Louisiana, met in special meeting session at its regular meeting place, on Tuesday, June 2, 2009 at 1:30 P.M. There were present the Honorable Everett C. Hobbs, Ed Larvadain, III, Chuck Fowler, Harry B. Silver, Myron K. Lawson and Jonathan D. Goins. Absent was Roosevelt Johnson. Also present were City Attorney Chuck Johnson, Assistant City Attorney Trey Gist and City Clerk Nancy L. Thiels.

The Council of the City of Alexandria, State of Louisiana, was duly convened as the governing authority of said City by the Honorable Myron K. Lawson, who stated that the Council was ready for the transaction of business.

Mr. R.T. Morgan, reporter with the Alexandria Town Talk stated that he hoped that the Executive Session would be completely legal.

Mr. Chuck Johnson, City Attorney responded by saying that the Executive Session would pertain to discussing pending strategy and litigation only on these cases.

Mr. Patrick LaCour was also recognized and stated that he had some information for the Council.

EXECUTIVE SESSION PURSUANT TO R.S. 42:6.1 (A) (2) ON THE FOLLOWING ITEMS

(1) To hear from the Administration and the City Attorney regarding strategy or negotiations concerning “City of Alexandria v. CLECO Corporation, et al.,” Civil Action #05-cv-1121-A, United States District Court, Western District of Louisiana, Alexandria Division.

(2) To hear a report from the Administration and the City Attorney regarding strategy or negotiations concerning "Armstead Franklin et al. v. City of Alexandria ," Civil Action # 07cv01011, United States District Court, Western District of Louisiana, Alexandria Division.

(3) To hear a report from the Administration and the City Attorney regarding strategy or negotiations concerning a proposed settlement between Louisiana Municipal Gas Authority (City of Alexandria and CrossTex/Louisiana Intrastate Gas) concerning natural gas transportation and related matters and the affect.

(4) To hear a report from the Administration and the City Attorney regarding strategy or negotiations concerning "N. S. in her capacity of natural tutrix and on Behalf of her minor children R.G and K.G. (heirs of Richard Goss) v. City of Alexandria, Clifton Fairbanks, Darren Coutee and Acadian Ambulance Service, Inc.," Civil Action #09-cv-9779, United States District Court, Western District of Louisiana, Alexandria Division.

A motion was made by Mr. Fowler and seconded by Mr. Goins to go into Executive Session to discuss the above items. A roll call vote was taken with the following recorded:

YEAS: Fowler, Smith, Silver, Hobbs, Marshall, Lawson.
NAYS: None.
ABSENT: Johnson.

The meeting was adjourned at 1:45 P.M.

The meeting was called back to order at 3:15 P.M. with a motion made by Mr. Fowler and seconded by Mr. Goins. The Clerk called the roll with the following present:

YEAS: Fowler, Larvadain, Goins, Silver, Hobbs, Lawson, Johnson.
NAYS: None.
ABSENT: None.

After the executive session was held, Mr. Patrick Lacour was again recognized. He handed out some information to the council members.

Mr. Michael Marcotte, Acting Director of Utilities responded to some comments made by Mr. Lacour. Mr. Trey Gist, Assistant City Attorney was also present to respond to some of the comments.

Mr. Lacour requested that all Cleco contracts be made available to the public. The Council requested him to make the request to the City Attorney.

There being no further business to come before the Council, on motion properly seconded, the meeting was adjourned.
